Terms of Business

General 1 Attribution and condition of lots
Every effort is made to ensure the accuracy of any statement as to authorship attribution, age ,date, origin, providence and condition of any lots whether or not such statement forms part of the description of any such lot. whether any such statement is made orally or written it is an expression of opinion given after careful consideration and research. Each buyer by making a bid for a lot acknowledges that they have satisfied themselves fully as to the attribution of the condition of the lot. In respect of the pictures it should be noted that these have not been removed from their frames unless specifically mentioned in the condition report. If any damage occurs to any lot before, during or after the sale such damage shall be made good by the person responsible for the damage.

Third Party Liability
Every person on Heckmondwike auction premises before, during or after a sale shall be deemed to be there at their own risk and shall have no claim against Heckmondwike Auctions in respect of any injury they sustain or any accident that may occur.

Refunds
We do NOT offer partial refunds, lots being returned for refund will need to be returned in whole for a refund after agreement has been made with Heckmondwike
Auctions.

Payments for Vendors
The net proceeds received from buyers in clear funds will be processed to the vendor no later than 28 working days from the date of the sale.

The Buyer's Payments
The highest bidder acknowledged as such by the auctioneer will be the buyer. If any dispute arises then auctioneer will have absolute discretion to settle the matter.
The auctioneer shall rule then bidding and no bid shall be retracted. The auctioneer has the
right to refuse any bid.

Registration
Respective buyer need to register prior to the sale, providing full name, address, contact numbers and email address. First time buyers will be required to provide proof of identity, ie Driving License, Passport,Utility Bill (showing their name and address). Upon the receipt of the above a paddle number will be issued which will be your allocated number for future sales.

Buyers Premium
The buyers premium is fixed at 18% of the hammer price.

Payment
Payment is due immediately after the sale and in Pounds and Sterling. The following methods of payments may be used - Debit / Credit cards, Cash up
to a sterling equivalent of £9000 & Bank transfer.

Collection of lots
Lots won can be collected from 10 .30am - 3.00pm the following Wednesday/Thursday/Friday & Monday once payment is made and completed. Bidders in the room can pay and collect on the day upon end of sale. Account not paid within 14 days will automatically be subject to an interest charge of 5% above base rate from the day of the sale.

Ownership of Purchases
Ownership of lot(s).Purchase will not pass to the buyer until the buyer has paid Heckmondwike Auction in full the total amount due and Heckmondwike Auctions have applied such payment to the lot.

Transfer of Risk
Each lot shall be the buyers sole responsibility from the fall of the hammer and be sold faults and imperfections Heckmondwike Auctions not being responsible the correct description ,genuineness or authenticity of any lot and making no warranty what so ever. The buyer is deemed to have inspected him/her self as to its condition. In specific circumstances, a lot incorrectly described which proves to be a forgery may be returned to Heckmondwike Auctions with in 14 days for a full refund .

Commission Bids
If instructed, Heckmondwike Auctions will execute bids and advise prospective buyers the service is free. Lots will always as cheaply as is allowed by such bids and reserves as on the Auctioneers book. In the event of identical bids the earliest will take precedence. There must always be a maximum amount indicated, ie The amount to which the buyer would bid if in attendance at the auction themselves. "Buy" or unlimited bids will not be accepted. Commission bids placed by telephone will be accepted at the clients risk. Heckmondwike auctions urge their clients to place such bids within one hour of the close of
the view day.

Telephone Bids.
Requests for telephone bidding must be registered at least 1 hour to the close of the viewing time.10 am is end of viewing. Lines are booked on a first come first served basis. Full name,address, telephone and proofs of ID with be required, Bank Debit/credit card details are also required to secure the line. If we are unable to contact you we will bid up to the lowest estimate on your behalf.

Absentee Bidding
Whilst every effort will be made to execute absentee bidding Heckmondwike Auctions can not be held responsible for any default or neglect in connection with this service.All such arrangements are made at the prospective buyers risk.

Storage and Collection
Please note Furniture, Carpets, Clocks and large works of Art, Lots will remain in the saleroom for 5 working days following each sale, after which they will be removed to store and arrangements for collection must be made in advance . Storage charges will be levied on all lots not collected within 7 days of the sale. This will include a handling fee per consignment as well as a storage fee of £5 per lot per day. No goods can be collected until all charged are paid.

Droit de Suite
Royalty Charges From 14th February 2006 all United Kingdom Art Professionals ( which
includes Auctioneers) are required to collect a royalty payment for all works of Art that have
been produced by living Artists, and those whom have died in the last 70 years. This payment is calculated on qualifying works of Art which are sold for a hammer price more that the UK Sterling equivalent of a 1000 Euros.( The UK Sterling will fluctuate in line with prevailing exchange rates. It is the responsibility of the buyer to acquaint themselves with the actual Euro to Sterling exchange rates on the day of the sale. The actual qualifying threshold will be calculated by the Artist Resale Right-Service Hub based on the European Central Bank Reference rate published at 2.15 pm on the day of the sale and can be found on
www.dacs.org.uk

Vendors commission You will pay 18% on the hammer price of each lot which sells. Lot fees are charged at £1 per lot and will be charged if sold or unsold.

Electrical Testing
All electrical items must meet current trading standards legislation which means they
must be tested for safety. We charge £1 per lot to test electrical equipment. We reserve the
right to dispose of unsafe equipment without your prior permission .

Advertising
We do not charge for advertising unless this is specifically agreed in advance with you.

Withdrawing from sale.
If you change your mind about selling your goods we will charge 20% of the estimated sale value or the reserve plus any costs we have incurred.

Collection Service
We offer a collection service charges at £35 per hour. This is subject to your location.

Buyer Default
We act as agents and can not be held responsible if your buyer does not pay. We can
not pay you until we have cleared funds
Shipping is available on all lots unless stated on the Catalogue lot description.

Any items damaged in transit is at buyers own risk.
