Definitions
A TCA means Transport Collector Auctions Ltd
B Auctioneer means the representative of TCA conducting the auction
C Auctioneers means TCA
D Vendor means the seller who offers the lot for sale
E Purchaser means the person to whom a lot is sold by the auctioneer
F VAT means Value Added Tax

General
1. All persons on the sale premises, at a venue borrowed or hired by TCA or associated companies are there at their own risk. They will have no claim against the Auctioneers or their employees in respect of any accident, injury, damage, or neglect however caused.

2. TCA reserves the right to refuse admission to an auction venue or its offices.

3. Prospective purchasers are advised to read all ‘Conditions of Sale’ and any ancillary notices before bidding on any lot.

4. All descriptions, whether printed, posted on the internet, or oral, are statements of opinion and not fact. All intending purchasers should satisfy themselves as to the condition, age, authenticity or any lot(s), however offered. Imperfections are not stated. All lots are sold ‘As Seen’ with all attendant with all faults and errors of description.

5. The Auctioneers reserve the right to accept or refuse any bid(s), regulate bidding and increments of any bid(s), rearrange, consolidate, or withdraw any lot(s) or part lot without reason or notice. In the event of a dispute, the Auctioneer has absolute discretion to settle such dispute.

6. Estimates printed in the catalogue, posted on the internet, or given orally, are supplied as guidance only to intending bidders, as prices for particular lots may vary depending on market fluctuations.

7. TCA, if so instructed, will execute bids on behalf of prospective purchasers. Commission bids will be executed as cheaply as possible given the bidding in the room and reserves. Telephone bidding is only accepted on lots with a minimum lower estimate of £100. TCA, its employees, servants and agents shall not be liable for any defaults relating to telephone or absentee bids, including staff and communications fault or failure. Buyers bidding via Commission Bids or Telephone are deemed to have viewed the sale and all relevant lots on which they intend to bid.

8. Any concession allowed by TCA shall not affect the Auctioneers rights, nor release the vendor or purchaser from liability in respect of these conditions.

9. Electrical Items. All electrical items are sold as non working and will require inspection by a qualified electrician prior to use

Vendor Conditions
10. The vendor indemnifies the Auctioneer and TCA, together with any of its employees, servants or agents, who act solely as agent for the vendor.

11. The vendor warrants to the Auctioneer, TCA and the purchaser that he is the legal owner of any lot, and is authorised to sell same and pass free and full title without any encumbrance of claim.

12. All lots are sold at the Auctioneer’s discretion unless written instructions to the contrary are received and agreed by the Auctioneer and TCA at least 36 hours prior to the advertised start of the auction.

13. TCA shall pay the sale proceeds to the vendor not later than 21 days after the auction, providing that the purchase price has been received by TCA. The Auctioneers reserve the right to withhold payment in the event of any dispute or claim

14. The vendor may, if confirmed in writing to TCA, withdraw an item from sale, but will be liable to 20% + VAT commission on the reserve or mid estimate, whichever is the lower, together with all other expenses incurred by the Auctioneers relating to the preparation and promotion of the lot.

15. All lots in placed in the care of TCA are so placed without insurance. The vendor retains responsibility for insuring their property until the fall of the hammer, at which point responsibility passes to the buyer. The vendor indemnifies TCA against any claim in respect to theft, damage or other negligence in relation to the care of their property.

16. Unsold lots. Vendors will be afforded 30 days free storage for unsold lots, pending arrangements for collection, or entering into a subsequent sale.

Purchasers Conditions

17. Potential purchasers are required to register with the auctioneer prior to the sale. ID must be provided, and a copy may be taken for records. On receipt of a completed registration form the sales office will provide the purchaser with a bidding number with which to bid in the auction. Online bidders must register via Easy Live Auction according to the platforms terms of service.

18. No bids will be accepted without a valid bidding number for the relevant sale.

19. In the making of a bid for any lot, whether in person, in writing, via the internet, or on telephone, purchasers are deemed to have read, understood and agreed to abide by all the current auction conditions.

20. The purchaser will pay to TCA the ‘Hammer Price’ together with a Buyers Premium of 20% + VAT on all lots excepting specially designated motor vehicles, where a Buyers Premium of 8% + VAT will be levied. Any additional VAT on the Hammer Price and its appropriate rate will be noted in the auction catalogue, the knowledge of which is deemed to be known to the purchaser.

21. A contract of sale is made between the vendor and the purchaser on the acceptance of a bid by the fall of the Auctioneer’s hammer. TCA is not a party to the contract of sale and has no liability for any act or default by either the vendor or the purchaser.

22. Responsibility for the purchased lot shall pass at the fall of the hammer; however legal title shall not pass until TCA is in the possession of cleared funds as payment for that lot. Purchased lots are the sole responsibility of the buyer and TCA will not accept liability in the event of loss, damage, or perceived negligence in respect of the care of the lot(s) following the fall of the hammer.

23. No lot(s) may be collected until the full purchase price and charges are paid. The purchaser will remove their purchase(s) on the day of the sale unless a prior agreement with TCA has been made. Any lot(s) not paid for will incur fees.

24. Lots not paid and collected by 5pm on the sale day will be subject to a £5+VAT (per lot) uplift fee and will be transferred to TCA’s storage facility from where collection can be arranged. Stored lots are eligible for 14 days storage without additional charge.

25. After 14 days storage (and without an agreement for collection / delivery in place) TCA will administer the following storage charges (lot category ratings may be found in the catalogue)
Category A Lots £5 +VAT per lot per week
Category B Lots £10 +VAT per lot per week
Category C Lots £20 +VAT per lot per week
Category D Lots £40 +VAT per lot per week

26. Full payment for all lots must be made to Transport Collector Auctions Ltd. TCA reserves the right to accept payment by cash to a maximum amount of £2,500, BACS and IBAN transfer, and debit card, which may be liable to a further surcharge or an amount in force at the time of the auction.

27. All lots must be paid for within 3 working days following the auction

28. Hazardous Substances. Some lots due to age may contain blue or white asbestos or other dangerous / harmful chemicals / substance. If handled incorrectly buyers may be in breach of COSHH (Controls of Substances Hazards to Health Regulations 1988) or the Health & Safety at Work Act 1974. The buyer undertakes to comply with relevant legislation with regard to the handling of such items and indemnify the auctioneers against any failure to observe this undertaking

29. TCA will undertake shipping of specified lots at the buyers risk. The buyer indemnifies TCA against any claim for loss or damage caused by third party shipping agents of goods in transit or not delivered. Please see the separate shipping policy for details of this service.

Participation
All participants in this sale are deemed to have read and understood the full Conditions of Sale as displayed in the saleroom, printed in the catalogue, and available via online platforms. All visitors to the sale site or storage facility are present at their own risk and will have no claim on the auctioneers, property owners, or lease holder in the event of any accident, injury or neglect, however caused.
Transport Collector Auctions are pleased to offer shipping on the majority of lots in our sales.
For simplicity each lot description will feature a shipping category as follows:
A Category A Items can be packed and sent via Royal Mail on their Tracked 24 Service as Small Parcels. Cost £15 + VAT Multiple Items may go in one parcel or may be upgraded to Category B / C. We will contact you after the sale if you have purchased multiple items with a formal quote.
B Category B Items can be sent by Royal Mail on their Tracked 24 Service as Medium Parcels. Costs £25 + VAT Multiple Items may go in one parcel or may be upgraded to Category B / C. We will contact you after the sale if you have purchased multiple items with a formal quote.
C Category C Items are generally large and heavy, or will require multiple parcels. These will be sent via a reputable 24hr courier on a signed for service. Cost £35 + VAT
D Category D Items are too large, bulky or fragile to post and must be collected from TCA by appointment within 2 weeks of the sale date.
All lots will be sent via tracked services, but entirely at the buyers risk. We will be happy obtain quotes for insured services following the sale.
Following each sale, all lots not paid and collected on the day will be removed from the saleroom and transferred to our storage facility (Postcode CB24 5QE).
Uplift from the saleroom is charged at £5+VAT per lot, and includes 14 days storage, in which time arrangements for collection / delivery must be made.
Lots remaining in storage in excess of 14days without arrangements for collection / delivery will be subject to storage fees as follows:
Category A £5+VAT per lot per week
Category B £10+VAT per lot per week
Category C £20+VAT per lot per week
Category D £40+VAT per lot per week
Buyers may arrange collection by third party couriers, by appointment, during normal business hours (9am-5pm Monday-Friday).
No lots will be sent or made available for collection without receipt of full and final payment.
