Buyers Terms and condition
1. Once the hammer price has been realised the Buyer will have agreed to the price, having bid to that amount. The buyer is then contracted to buy the item and failure to do so will constitute a breach in these Terms and conditions. TSA as the auctioneer for the items on behalf of the seller will, after a Two week period, contact the Buyer to agree terms for paying for the items (which has been agreed by the seller), or shall do any of the following.
a. End the sale of items to the Buyer, and any other items that the buyer has won. Put them up for re-sale at the next Auction or if Second bidder is known, will sell it to the second bidder (any shortfall of hammer price will be charged to the buyer who has failed to pay.
b. Will potentially look at proceeding with damages for breach of contract.
2 A buyers premium of 15% of the hammer price is payable by the buyers of all lots. Winning bids received through Easyliveauction.com are subject to an additional 3% plus vat premium. However a better option will be doing the £3 registration fee and that means that no extra fees are added. This is advantageous only when spending over £100.
3. We do accept bids by email, by post prior to the auction, or in person. These need to arrive to us by the following means. By email to
[email protected], Or by Post to TSA, 138 the Stour, Grange, Daventry, NN11 4PT. Or on Terrys Footy Memorabilia Stall on Northampton Market, every Thursday and Friday. Please fill in any correspondence, with Full Name, Address, Telephone Number and email address.
4. TSA Ltd cannot accept responsibility for any late delivery of bids, however to offset that chance you can always call us at the office the day before an auction to give us the details of your bids, this will ensure you don’t miss out. At the same time all information shall be required (As previous). The number to call TSA is (07463809676). Anything not received before 24 hours before (with Postal, Email and by Hand) may not be accepted.
5. Telephone bidding is also available. The process begins with a request to the office for this service. As we need to ensure we have enough phone lines available to us, the buyer needs to call us 24 hours before the event to request this. On the day the Buyer will be called about ten minutes before the lot interested in, this is to ensure the Buyer is ready, then as the prior lot commences. The Lot bidding on, must have a minimum estimate of £100. We will try our best to have a nice smooth service to the telephone bidder and the bidder will pay a commission fee of 17% on hammer price. TSA Ltd will try twice to contact the bidder, however after this no further attempts will be made. It is the duty of the bidder to be ready, within a time period discussed before the event.
6. Once successful the BUYER will receive an invoice for paying and upon that can decide whether they collect or have the item posted or a courier to collect. The buyer will not be allowed to take any items without payment. The Buyer will let us know on return of invoice how they would like to proceed, either collection or postage. If postage is the option then we look to send postage costs to you and that will be a stated fee of no more than £3 plus postage and packing at cost. If the option is courier then the courier will need to contact us to let us know that they will be coming and we will arrange the items to be available at the time they arrive. Collection of items is also to be arranged. Any item sent by post will be the risk to the buyer, we do have the option of Postal insurance and this will be quoted to you. However we cannot accept responsibility after the item/s have left our control for any loss or damage. In this case the buyer will have the duty to process any claims with the relevant Courier or Postal company. We will ofcourse give receipt of postage and proof of postage.
7. The hammer price determines the selling price before commission is added, the highest bidder is the Buyer. On the rare occasion that a dispute occurs about the winning bid, the Auctioneer has the right to settle the issue by re selling the lot or accepting the initial result of the bids.
8. Terrys Sports Auctions will withdraw any lot that he/she deems unsuitable for auction or not described by seller correctly. This for instance could be a reproduction, fake or other description that may cause distress to the buyer. These are listed generally by the Seller and the TSA cannot always look at every programme/ etc given to us for sale. Therefore if an item is brought to our attention in a negative way we will withdraw it.
9. When making a bid the buyer knows that the commission fee is 15% plus EasyLive Auction commission of 3.%. This is due on each item won online at the auction. We have the right to apply a higher commission if and when the rates are higher to us from the Auction Portal (Easy Live Auction).
10. Winning bidders at the auction can pay on the day for the items and take them away with them. The buyer shall let the office know his/her paddle number and list of items won and will be issued with an invoice to pay. Once paid the invoice will be printed AS PAID and the Buyer can hand it to a porter who will get the items won. All other bidders, online, telephone or non attendee commission bidders will be sent an invoice, with details of how to pay and how they’d like to receive their items. Payment should be made within two weeks of Auction. Invoices will be generally generated and either posted or emailed within two days of auction. Late payments will be liable to a charge of £5 per week or £5 of any week part of.
11. We take non payment very seriously, so in this unlikely event we will endeavour to take steps to recover monies owing and the Buyer will be liable for such undertakings. These steps may include, Court fees, Solicitors fees, bailiff fees, debt enforcement fees etc. However in all instances we will try to avoid this. Once the issue has been resolved the buyer will be banned from future bidding without exception.
12. We can take payments through the following ways. Card (No credit cards) Debit cards, Bank Transfers and cash. All funds should be cleared before any lots are removed. All payments should without exception be made in British Pounds.
13. During sale, lots can be removed providing they have been paid for. No lots can be removed until funds cleared.
14. The Buyer becomes the owner of the lots only once cleared funds. The owner cannot claim ownership and sell items on until this has been achieved.
15. All statements made in the catalogue, telephone conversation, email, statement or advertisement of the auction regarding the age, provenance, authorship, attribution, date of item, authenticity, condition or estimate of value is a statement of opinion only. Every Buyer should look into the items they wish to buy or rely on their own expertise in determining the value of the item, authenticity etc. In all cases TSA will provide extra photos and viewing for buyers to determine themselves. TSA are an agent to the sellers and such are selling on their behalf, anybody who works for TSA are working on behalf of them and cant be responsible for any errors given by the seller. All lots offered for sale are not covered by the Sale of Goods Act.
16. Any Buyer can within two weeks with written notice, return an item in its original sold condition to the auction House if they feel that item is a forgery. The Buyer will need to also return the item to the office the Auctioneer will view the item and determine through close examination if it is deemed such. If agreed by Terrys Sports Auctions ltd the item will be refunded including commission to the buyer. A deliberate forgery implies that the seller has deliberately lotted an item intentionally to deceive TSA ltd and its customers. The Seller will be banned.
17. Any lots not paid for or collected from the auctioneer within 30 days of the auction shall be liable to a storage charge at the rates applicable at the time by the auctioneer. £5 per week. Or week thereof.
18. All bidders who bid for any lot in person, by commission bid, telephone bid, internet bidding through the Portal Easyliveauction.com or by any other method shall be deemed to have accepted and agreed to these terms and conditions of sale in their entirety. All lots are offered for sale strictly according to these terms and conditions of sale and no other terms shall apply.
19. All overseas bidders will need to accept upon bidding that if they win they need to pay for any taxes, customs charges or duty, that their country charges on the items. All items sent abroad will be insured at your cost and all Customs declarations will be sent with every package as per normal customs arrangements between the UK or any other country where these arrangements are required.
20. These terms and conditions shall be governed by and construed in accordance with English Law.
