Viewing available on Friday 7th July and Saturday 8th July between 9am-4pm both days. Lots 1-194 which include jewellery, silver, figurines, books, toys etc can be viewed at Unit 9B, Ellough Industrial Estate, Beccles, Suffolk, NR34 7TD. Lots 1001-1194 which include furniture, maps, pictures, rugs and garden items are to be viewed off-site. Please contact us for the address of the property. For the collection of all Lots, please make an appointment. Condition reports requested from 5pm onwards on Saturday 8th July will not be processed. All sizes and weights are approximate.

BUYERS PREMIUM: A Buyers Premium of 20% plus VAT (24% inclusive of VAT) is payable on each lot. Timed Auction lots purchased via Easy Live Auction will be subject to an additional 3% plus VAT (3.6% inclusive of VAT) on the hammer price. All items will be sold via a Timed auction on Easy Live Auction.

BIDDING: The highest accepted bidder shall be the Purchaser. All bidders on Easy Live Auction must register with the Auctioneers with a valid personal debit card prior to placing a bid. All intending bidders must make prior arrangements regarding method of payment and collection before participating in an auction. In completing the bidder registration on Easy Live Auction and providing your card details and unless alternative arrangements are agreed with Beccles Auctions, you authorise Beccles Auctions, if they so wish to charge the card given in part or full payment including all fees for items successfully purchased via Easy Live Auction. The Auctioneer has absolute discretion to withdraw any lots, to refuse bids and to decline bidders. The Auctioneer reserves the right to bid on behalf of the vendors for any Lot and to withdraw, consolidate or divide any Lot or Lots. No lots will be transferred to a third party after the auction.

CONDITION OF LOTS: Every effort is made to ensure the accuracy of any statement as to authorship, attribution, origin, date, age, provenance and condition of any lot whether or not such statement forms part of the description of any such Lot. Whether any such statement is made orally or in the catalogue it is an expression of opinion and should not be relied on as an inducement to bid for the Lot. Certain items are catalogued as “as found” i.e. damaged or restored etc. All items are “sold as seen”, with all faults, imperfections and errors of description whether declared or not. Some descriptions may refer to damage or restoration but the omission of such a statement does not imply that a lot may be free of damage or has been restored. It is the responsibility of any perspective bidder to physically inspect any lot in person and satisfy themselves as to the condition before making a bid as to the origin, age, authenticity, weight, quality and condition.

CONDITION REPORTS: Written condition reports are available for all Lots upon request. Buyers that do not request condition reports forfeit their right to a refund, except where we are in breach of Contract. The Auctioneers will not be held responsible for any damage or defect that has not been notified to the buyer. Verbal reports on the condition of any lot can only be offered by the Auctioneers as a statement of opinion, and not fact. Condition Reports are for guidance only.

TRANSFER OF RISK: Each lot shall be at the purchaser’s sole risk from the fall of the hammer and shall be sold with all faults and imperfections. The purchaser is deemed to have inspected the lots and satisfied himself as to their condition. The liability to insure any purchased Lot shall pass from the auctioneer to the purchaser on the fall of the hammer.

PAYMENT: We do not take any form of payment over the telephone unless they are known to Beccles Auctions. Payments can be made via the online link/invoice from Easy Live Auction, in person with a personal debit card, cash, or by bank transfer. All bank transfer payments from oversea buyers shall pay the bank fees in addition, if not, we reserve the right to take the payment from your card supplied via Easy Live Auction. We reserve the right to take payment on the third working day after the auction, if payment has not been received. All payments must be in Sterling. We do not accept credit cards, business debit cards, international debit cards or cheque payments.

MONEY LAUNDERING: In order to comply with current anti-money laundering legislation we are unable to accept cash payments over £8,000. Any purchaser wishing to pay cash for any purchase over £1,000 may be asked for identification e.g. passport or photo driving licence.

BUYERS COLLECTION OF GOODS: No Lot or Lots can be removed until the whole amount of the Purchasers account has been paid in full. Collection of purchases may be claimed and removed from 12noon the day after the auction has concluded at the purchaser’s sole expense and risk, and taken with all faults or errors of description. Removal of items from the room will be the responsibility of the buyer and they will be liable for any damage arising from the removal. It is the buyers responsibility to check the completeness of a lot before removal as no responsibility can be accepted by the Auctioneers once the lots have left the premises. After 5 working days, storage charges of £2 plus VAT (2.4% inclusive of VAT) per lot per day will apply to any goods that have not been collected, unless a prior arrangement has been made. Beccles Auctions shall not be responsible if any Lots are lost, stolen, damaged or destroyed and they will remain at the sole risk of the Purchaser.

COMPLIANCE: Upon failure of any purchaser to comply with any of the above conditions any money deposited by the purchaser in part payments shall be forfeited to the owner of the lot, he paying there from, all just expenses. Any lot not paid for within 14 days of the purchase date shall be resold by public auction or private contract and the deficiency (if any) arising from such a resale together with all expenses attending the same shall be made good by the defaulter at this sale who shall have no claim to any surplus which may arise on a resale. Any lot which has been paid for and is not removed within 1 month of the auction, the Auctioneers may re-sell them by auction or privately without notice to the buyer.

VIEWING: Viewing will be the day prior to the auction, or by appointment only. Any person damaging any Lot or Lots as a result of handling or otherwise during viewing or at any other time shall be liable to pay for the said Lot or Lots damaged at the reserve figure or Auctioneers valuation.

ATTRIBUTION OF PICTURES: The forename(s) (or asterisks where not known) and surname of the artist indicates in our opinion a work by the artist. The initials of the forename(s) and the surname of the artist indicates in our opinion a work of the period of the artist which may be wholly or in part his work. The surname of the artist indicates in our opinion a work of the school or by one of the followers of the artist or in his style and of uncertain date. “Bears signature” indicates in our opinion that this is not the signature of the artist.

DROIT DE SUITE ROYALTY CHARGES: In accordance with Artists Resale Rights Regulations 2006, we are required to collect a royalty payment for all qualifying Works of Art. This charge is payable by the purchaser of any work of art that has been produced by a living artist or for a period of up to 70 years after the artist’s death. Lots with a hammer price more than £1,000 UK sterling, but less than £50,000 UK sterling is 4%. For qualifying items that sell for more than £50,000 UK sterling a sliding scale of royalty charges will apply. Please refer to www.dacs.org.uk for further rules and current exchange rates. The royalty charge will be added to purchase invoices and must be paid before items can be cleared. All Royalty charges are paid to the Design and Artists Copyright Society (DACS) by the Auctioneers and no handling costs or additional fees with respect to these charges will be retained by the Auctioneer. There is no VAT payable on this royalty charge.

ELECTRICAL ITEMS: All electrical items are PAT tested for safety and labelled accordingly. This in no way implies that the item is in working order and no refund is available to the purchaser if the item is faulty. All electrical items listed as a 'Collectors Item Only' within the catalogue are sold untested, without warranty or any guarantee as to safety, serviceability or working order and are sold for display purposes or historical interest only.

AUCTIONEERS MARGIN SCHEME: The Auctioneers Margin Scheme allows auctioneers to sell items without VAT on the hammer price. Under the margin scheme an amount equivalent to VAT at the current rate is added to the Buyer’s Premium and internet charge. This amount cannot be refunded. The VAT element will not be shown separately on the buyer’s invoice. We do not allow buyers to opt out of the margin scheme. All items entered into auction are sold under the Auctioneers Margin Scheme. All items are sold as a private individual or non-VAT registered business.

THIRD PARTY LIABILITY: Every person on the auctioneers’ premises or premises hired by the Auctioneers, prior, during or after a sale or at any other time, shall be deemed to be there at their own risk and shall have no claim against the auctioneer in respect of any injury they may sustain or any accident which may occur.

PRE SALE ESTIMATES: Given by the auctioneers or a member of their staff are their opinion as to what they consider any particular lot is likely to realise. However any lot may sell at a figure less than the lower estimate and for more than the higher estimated figure. The auctioneers and their staff reserve the right to alter their pre-sale estimates, either upwards or downwards, on any lot at any time, up until such time as the lot is offered for sale.

RESCISSION: Notwithstanding any other terms of these Conditions, if within fourteen days of the date of sale Beccles Auctions receive from the buyer of any lot notice in writing that in his view the lot is a deliberate forgery and the lot is returned to them in this period in the same condition as at the time of sale and produces written evidence, the burden of proof to be upon the buyer, satisfies Beccles Auctions that considered in the light of the entry in the catalogue the lot is a deliberate forgery then the sale of the lot will be rescinded. The purchase price will be refunded once the sum has been returned to Beccles Auctions by the Seller. If before the proceeds of the sale have been paid to the Seller Beccles Auctions receives notice from the buyer that, in the buyers view the sale should be rescinded and Beccles Auctions agrees with that view, Beccles Auctions will rescind the sale and refund to the Buyer any amount paid to Beccles Auctions in respect of the Lot, and if such notice is received after payment of the proceeds of this sale the Seller will on notice reimburse Beccles Auctions to the full amount of the sum refunded to the Buyer
