1 ACCEPTANCE OF TERMS: Each potential buyer by making a bid on any lot acknowledges they are fully satisfied with the condition of the lot at time of sale and the conditions of sale as set out herein, and any amendments to conditions printed / displayed elsewhere, or as made known by the Auctioneers prior to the sale.
2 CATALOGUE DESCRIPTIONS: Descriptions are provided as a guide to the lot offered only. Unless expressly stated, all lots comprise of second-hand goods. All lots are sold as seen, with all faults, imperfections, errors of description howsoever caused. No warranty or guarantee of any kind is given on any lot unless expressly stated in the lot description or by the auctioneer at the time of sale. All lots will be available to view at the advertised time prior to sale. By making a bid, buyers acknowledge they viewed the lot in person and/or have otherwise fully satisfied themselves as to the condition of the lot prior to making a bid.
3 ELECTRICAL ITEMS: All electrical items are sold as non-working display items of historical interest only, even if they are displayed working at the time of viewing, sale, or in any pre-sale photo or video. Buyers undertake to have each electrical item they buy tested for safety by a qualified electrician before any attempted use. The Auctioneers accept no responsibility for the electrical safety of any item offered for sale.
4 CONDUCT OF AUCTION: The Auctioneers have absolute discretion to advance the bidding at varying increments, divide any lot, combine one or more lots, re-offer a lot which is disputed, to refuse bids, alter the order of the sale without prior notice, stop the auction, or bid on behalf of the vendor subject to any reserve price set.
5 THE BUYER: The highest bidder on each lot shall be the buyer of that lot (subject to any reserve price set by the vendor). At the fall of the hammer each lot shall be at the sole risk of the buyer, but ownership of such lot shall not pass until cleared payment has been received by the auctioneers. At the fall of the hammer, the buyer may be required to pay in full, or a deposit against the lot just bought, and if the buyer fails to do so, the lot may be re-offered for sale at once.
6 BUYER’S PREMIUM: A buyers premium will be added to the hammer price of each lot. Our standard buyer’s premium is 20% (minimum £1 per lot), but this may vary at different auctions.
EASYLIVEAUCTION FEES: Lots purchased online via easyLiveAuction.com attract an additional charge of either 3% + VAT per lot, or a £3 flat fee covering the whole auction.
7 DROIT DE SUITE: Any paintings, prints, photographs, sculpture or other original work of art by living artists selling for over 1000 EUROS equivalent are subject to a 4% royalty. This charge will be added to the buyer's invoice and is not subject to VAT. Royalty payments collected by the auctioneers are paid to the Government appointed body DACS for distribution to the original artists.
8 VAT at the current rate is payable on any lots marked with an asterisk (*)
9 PAYMENT: All lots must be paid for by close of business on Tuesday following the sale and collected at the buyer’s expense as soon as possible after payment has cleared. The Auctioneers accept payment by Bank Transfer or Cash only. Cheques / Credit / Debit Cards are NOT accepted.
10 COLLECTION: No lot may be removed from the auction premises until paid for. At the fall of the hammer, all lots are at the risk of the buyer. The Auctioneers shall not be responsible for any loss or damage howsoever caused.
11 STORAGE: Free storage of lots is offered for 7 days* after the auction in order for buyers of larger items to arrange transport. After this time, storage is charged at £1 per lot per day.

12 SHIPPING: The Auctioneers do not offer an in-house shipping service.
13 UNCOLLECTED LOTS: Lots remaining uncollected 28 days* following the auction will be disposed of by auction without reserve, the net proceeds used to pay the storage and disposal fees (subject to a minimum administration fee of £10 per lot), and any deficit or surplus will be charged or paid to the buyer as appropriate.

14 RESCISSION: Notwithstanding the above terms, if within 7 days of purchase of a lot the buyer gives notice in writing to the auctioneers that in their view the lot is a deliberate forgery, and within a further 14 days returns such lot to the auctioneers in the same condition as at the time of sale together with evidence supporting their claim of forgery, then if in light of such evidence it appears to the auctioneers the lot is indeed a forgery, the purchase of that lot shall be rescinded. The buyer shall be refunded within 7 days of the auctioneers receiving the amount paid by the buyer from the vendor. The auctioneer’s decision in such matters shall be final, and buyer and seller agree to be bound by such decision.
15 DEFAULT: An auction bid forms a legally binding contract. In the event of non-payment from a buyer for a lot, the lot shall be deemed unsold and the buyers details shall be made available to the vendor to pursue the defaulting buyer. Details of the defaulting buyer will be made available to other Auction Houses and published in the press to help combat fraud. Details may also be passed to credit reference agencies. The Auctioneers accept no responsibility whatsoever on account of the defaulter. The Auctioneers shall not pay out on, or contra against any lot or lots until cleared payment in full has been received from the buyer.
16 DAMAGE / LOSS: Any person causing breakage or damage to any lot or the premises shall be liable to pay in full the reserve price of the lot in question, or a price set by the Auctioneers if there is no reserve or if the reserve stated is grossly above or below the market value of the item as determined at the Auctioneers sole discretion.
All persons visiting the auction premises do so at their own risk, and shall have no claim against the Auctioneers in respect of any accident, damage, injury or loss howsoever caused, unless such loss or damage resulted from direct negligence of the Auctioneers.
In the interest of serious buyers and for their own safety, children are not admitted to the auction premises.
17 AUCTIONEERS AS AGENTS: The Auctioneers act as agents only. The vendor of any lot indemnifies the Auctioneers against any and all claims in connection with any goods offered for sale or sold.
18 GOVERNING LAW: These conditions shall be governed by and construed in accordance with English law, errors and omissions excepted.
