BUYERS PREMIUM & VAT: A buyer’s premium of 17% inclusive of VAT is charged on the hammer price of all lots - unless otherwise has been indicated within the auction catalogue. Our auction host charges an additional 3% fee to register for bidding, taking the total fee to 20%. If a vendor is VAT registered, an additional fee for VAT will be added on the hammer price. If this is the case, you will be informed of this additional fee within the item's description in the auction catalogue. Vat will be charged at the current rate of 20%. Upon completion of the sale, an invoice will be provided to the successful buyer. If you require an additional VAT invoice, please contact us.

BIDDING: Your bid is a legally binding contract. All bids are final, and a buyer cannot retract or cancel their bid at any point under any circumstances. Fosse Lane Auction have absolute discretion without giving any reason, to refuse registration to any person. The vendor may alter or withdraw any of their submitted lots before or during the sale. All bids are to be placed through our auction host Easy Live Auction via a registered bidder's account. All bids will be treated as valid, regardless of it has met the reserve. From time to time, a vendor may request a lowering or removal of the reserve, which would therefore render a bid successful. Upon the fall of the hammer, responsibility of the item will fall solely with the buyer, and it is in the buyer's discretion to seek any insurances regarding any goods successfully purchased.

PAYMENT: All invoices must be paid in full prior to collection of the goods. PAYMENT SHOULD BE MADE TO FOSSE LANE AUCTION using the payment details provided on the invoice. Goods will not be removed from site until payment has been made and cleared. Payment can be online by debit/credit card, and the link to do so will be contained within the invoice email. Fosse Lane Auction will also accept payment using bank transfer, cash, or debit/credit cards by phone. Cheques may be accepted as long as prior consent has been given by Fosse Lane Auction, and the goods will be held until cheques are cleared.

BANK TRANSFERS: BACS payment can be made directly into our account (please contact us for bank details). By creating an account with Fosse Lane Auction through easyliveAuction.com, you are required to provide your credit/bank card details. You authorise Fosse Lane Auction, if required, to charge the credit/bank card given in part or full payment, including fees, for goods successfully purchased.

DEFAULT BY THE BUYER: If at any time the Buyer has failed to pay in full by end of day on final collection day of the auction from which the goods were purchased, or failed to remove any lot purchased by the final day of collection then: i) A late collection fee of £3 per day will be added to the cost per item which is not collected within 4 days of the auction completion, unless prior agreement with us has been met. A further fee may be added to cover storage, wages and other expenses incurred - at our discretion. Any balance held by us owed to you may be used to cover the item's purchase price, and any incurred fees; ii) We may remove the lot from the premises and leave it outside at the Buyer’s risk and expense; iii} Lots which are not collected by the end of the week following the auction will be deemed abandoned by the buyer, and will either be returned to the vendor, disposed of, or entered into a future auction. Any costs relating to the item's disposal may be charged to the buyer. iv)At our discretion, we may deem it necessary to place restrictions or blocks on any future bids placed by defaulting buyers.

DATA PROTECTION: We will hold and process any personal data in relation to bidders and vendors in accordance with our current privacy policy, a copy of which is available upon request.

THIRD PARTY LIABILITY: Every person on Fosse Lane Auction premises at any time shall be deemed to be there at their own risk. They shall have no claim against Fosse Lane Auction in respect of any accident which may occur, or injury, damage or loss howsoever caused, save in so far as the injury, damage or loss shall be caused by the direct negligence of Fosse Lane Auction employees.

FAULTS AND ERRORS: All lots are sold ‘as seen, as they lie’ and without warranty, regardless of the description in the catalogue. They are sold with all faults and errors or mis-statement or description, measurement, weight, quantity, quality, number or otherwise (whether of a substantial nature of not). The Purchaser holds full responsibility to inspect the lots he buys, and to satisfy themselves as to the accuracy of titles, descriptions, condition and specifics. IF THEY BUY WITHOUT PREVIOUS INSPECTION, THEY SHALL DO SO AT THEIR OWN RISK. All lots will be made available for inspection prior to purchase. We assume any responsibility for the condition or any factors relating to it.

COLLECTION AND REMOVAL OF GOODS: Any goods purchased on site at Fosse Lane Auction must be located, retrieved and handed over by a member of Fosse Lane Auction staff, unless prior agreement has been met. Under no circumstances must a retrieval or removal of an item be attempted by the buyer without given consent. Any injury, damage or other loss to the buyer, his possession, other lots within the sale, building fabric or other goods or persons suffered at any point during the collection and removal of goods will be at the sole responsibility of the buyer, unless clear and proven negligence on behalf of an employee at Fosse Lane Auction is present. Once an item is removed from the premises, Fosse Lane Auctions or the vendor retains no liability or responsibility. It is the responsibility of the buyer to deem goods suitable and worthy for their own intended uses. Pallets, stillages, baskets, etc. used for the display of the lot are not included in the sale lot unless otherwise stated or agreed prior to its removal. It is the buyer's responsibility to ensure that the goods they are collecting are being stored and transported in a safe and secure manner, and in a way which aligns with any rules and regulations which may apply to any specific items.
