BUYER’S CONDITIONS OF SALE
• The highest accepted bidder shall be the purchaser. If any dispute should arise between bidders or any mistake is made the lot may be put up again. The auctioneer is the final arbiter.
• The advance in the bidding will be regulated by the auctioneer who reserves the right to refuse any bidding, bid on behalf of the vendor on any lots upon which there is a reserve, to withdraw, consolidate or divide any lot before or during the sale.
• No lots may be removed until the buyer’s account is paid in full. The buyer shall not become the owner of any lot; and the auctioneer shall have a lien thereon, until the buyer’s account is paid.
• All lots must be paid for and removed as soon as possible. Any delay in collection of multiple or larger items such as furniture may result in the buyer incurring storage charges. Purchasers who fail to pay and collect within seven days of the sale may have their bids refused in future sales.
• Payment can be made by cash, debit card or bank transfer. Customer not present card transactions will be limited to £500. We do not accept payment by credit card.
• We conduct appropriate Due Diligence checks to comply with current Anti-Money Laundering regulations. Any buyer exceeding the threshold of £8,000 per invoice will be required to provide photo identification such as passport or driving licence before purchased lots will be released. We reserve the right to withhold the purchased lots until such checks have been completed. The information will be securely stored for as long as legally required.
• A buyer’s premium of 25.2% inc VAT is charged on the hammer price (Plus online bidding fees if applicable as shown below)
Online Bidding
We offer an online bidding service on our website, via easyliveauction.com or the-saleroom.com for bidders who cannot attend the sale. In completing the bidder registration and providing your credit card details and unless alternative arrangements are made with Warren & Wignall Ltd, you;
o authorise Warren & Wignall Ltd, if they so wish, to charge the credit card given in part or full payment, including all fees, for items successfully purchased in the auction via your chosen online platform.
o confirm that you are authorised to provide these credit card details to Warren & Wignall Ltd through your chosen online platform and agree that Warren & Wignall Ltd are entitled to ship the goods to the card holder name and address provided in fulfilment of the sale
Please note that any lots purchased online will be subject to an additional 3% commission charge plus VAT at the rate imposed on the hammer price on our website or easyliveauction.com and 5% plus VAT on the-saleroom.com
Telephone Bidding
Telephone bidding is available on the Collector’s and Jewellery sale only, subject to availability. All requests must be registered before the sale commences and telephone lines are booked on a first come first served basis. We will use our best endeavours to contact prospective buyers to enable them to participate in bidding by telephone, but we do not accept liability for failing to do so or for errors and omission in connection with telephone bidding arising from circumstances beyond our control. Absentee Bidding
Whilst reasonable endeavours will be made to execute absentee bidding up to the Day of Sale, Warren & Wignall will not be liable for any default or neglect in connection with this service. All such arrangements therefore are made entirely at the Prospective Buyer’s risk. A buyer’s premium of 25.2% inc VAT is charged on the hammer price.
Condition Reports & Descriptions
We can provide condition reports upon request up until the close of business on viewing day, we cannot guarantee a reply for requests made after this time. A Condition Report is an honest expression of our opinion, not a statement of fact and is provided as a service to the seller. Our Condition Reports are not prepared by professional conservators, restorers or engineers, and are prepared with the naked eye unless otherwise stated. The absence of a Condition Report from a lot does not mean that the lot is in perfect condition. The auctioneer undertakes that care has been taken to see that catalogue descriptions and condition reports are accurate, but these must be taken as matters of opinion only and shall not be taken as statements of fact. Buyers must make their own judgement as to the nature, authenticity or condition of any lot. All lots are available on public view ahead of an auction and we encourage prospective buyers to inspect an item in person where possible. The auctioneers do not give any warranty as to the title of the lots sold and will not be liable for any defect in such title.
Registration
Prospective buyers must register before bidding and obtain a bidding number. New buyers are required to provide full name, address, contact number, email address and identification, such as driving licence or passport.
• We offer an in-house postage and packing service, depending on size and quantity. We will always be as accommodating as possible, but we are not professional packers and do not have the same resources as specialist couriers. Please contact us for a quote before bidding.

• Items are sent entirely at the buyer's risk and in the event of loss or damage to items posted it is the buyer’s responsibility to make any claim from the insurance (if any) made on their behalf.
• Any damage caused by removal of goods must be made good by the person committing the same. Principles being considered responsible for the acts of their servants.
• Any items remaining unpaid for may be resold and any deficiency made good by the defaulter.
