Public Liability - Visitors to the Salerooms, including those attending auctions, making inquiries, viewing, delivering, or collecting items do so at their own risk and under the auctioneer’s supervision.

Neither the auctioneer nor their employees/agents are liable for loss, damage, accidents, death, or injury unless caused by the negligence of their employees/agents or as required by law.

Health and Safety -Visitors are advised to consider the premises layout and security
arrangements for health and safety purposes.

Additional Notices
• The Saleroom is not responsible for the cancellation or postponement of sales due to circumstances beyond its control, such as technical failure or natural disasters.
• The auctioneer may refuse admission to an auction or the premises to anyone at their discretion.
• Vehicles parked onsite are at the owner’s risk.
• Smoking and vaping are strictly prohibited anywhere on the premises.
• No children under 16 years
• No dogs

Eligibility to Participate - Participants must be at least 18 years old.

Western Salerooms Ltd can refuse or cancel registration and bidding rights at their discretion. Individuals who do not comply with these terms and conditions will be prohibited from accessing our auction site and bidding online.

Agency - As auctioneers we represent the seller, whose identity remains confidential. When you purchase an item at auction, your contract is with the seller, not with Western Salerooms Ltd. Both we and the seller have the right to enforce the Terms and Conditions of Sale against you in case of a breach. These Terms are exclusively between you and Western Salerooms Ltd; no other party has the right to enforce them.

Warranty of title and availability - The Vendor / Seller guarantees both the auctioneer and the Buyer that they are the legitimate owner of the consigned property or have received proper authorisation from the owner to consign it for sale. Furthermore, the Vendor /Seller guarantees that the property has a clear title, free from any claims by third parties.

Estimates - Estimates provide Buyers with an anticipated price range for a lot. The reserve price will not exceed the low estimate. Estimates exclude the Buyer’s Premium, online sales premium, and any applicable VAT or Artists Resale Rights. Prepared in advance, estimates may be adjusted prior to the sale and are not definitive.

Reserve Prices - A lot may have a reserve price which is the minimum amount a seller is willing to accept for a lot at an auction. If bidding does not reach this price, the item will remain unsold.

Catalogue Descriptions and Modifications - The auctioneer/ salerooms reserve the right to amend any descriptions or statements in the catalogues, either verbally or in writing, before or? during the sale. Catalogue descriptions are provided as opinions to assist Buyers and are not definitive. While we strive for accuracy, all statements—oral or written—are made without responsibility, except where specifically instructed to certify by a Vendor / Seller. Items are described based on basic observations unless otherwise advised by the Vendor / Seller.

Liability for Descriptions - The saleroom is not responsible for mistakes in descriptions, condition reports, or any other information about the lots, unless the errors are intentionally misleading. Buyers should know that these statements do not create any legal entitlement, the right to claim damages or cancel transactions with the saleroom or the seller. This is especially important for absentee Buyers, who should not depend only on reports from auctioneers or others, as mistakes or inability to check the condition of lots do not allow them to seek compensation or cancel a transaction.

Condition of Items - Given the nature and age of many lots, items may not be in new condition. While some catalogue descriptions may mention specific damage or restoration, the absence of such references does not guarantee that a lot is free from defects, nor does any reference to a particular defect imply the absence of others. All descriptions are as accurate as possible. Where there is an obvious fault, we will endeavor to notify such with A/F in the description, but items with defects are not limited to A/F listed goods. Buyers are strongly encouraged to inspect items thoroughly before bidding, as lots are sold “as seen” and may contain various faults, imperfections, or discrepancies in description. Lots may be new, used, refurbished or not, working or broken, soiled, damaged, incomplete, etc. Boxed goods may not contain any relevant books, manuals, disks, leads, etc., and/or might contain different colors/models/or even different products. It is essential for Buyers to ensure their satisfaction regarding authenticity, quality, age, weight, size, completeness, and condition prior to placing bids.

Condition Reports and Illustrations/Photographs - Condition reports can be requested to assist Buyers who are unable to view items, but they do not cover manufacturing defects. Illustrations/ photographs in catalogues are for guidance only, as colours and appearances may vary from the actual items. They may not reveal the true condition of the lot. We strongly recommend that you inspect the lot yourself and consult an independent professional conservator or restorer. In providing a condition report, we are not entering into a contract. Any statements contained in our report are expressions of our opinion and not statements of fact. Such statements do not imply any basis of fact upon which the opinion may be founded. In the event of a successful bid in relation to the lot, you will have purchased the lot with no reliance on the condition report. We will endeavour to respond quickly to any request for a condition report, however this may be restricted by time constraints and staff availability. Condition reports cannot be prepared on the day of the sale.

Deliberate Forgeries - Deliberate forgeries need to be notified within 7 days and returned for a refund within 21 days.

Warranty and Guarantee - No warranty or guarantee is given on any item.

Buyer Responsibility - We advise Buyers not to bid unless they have thoroughly examined the lots to their satisfaction beforehand. By placing a bid, purchasers acknowledge acceptance of the lot as presented, confirming that they have performed their due diligence and are aware of the associated risks. If there is any uncertainty, do not bid.

Containers - Containers such as pallets, stillages, baskets, skips, etc., used for the display of the lot are not included in the sale lot unless stated.

Viewing Arrangements- Items are available to view in our online Easy Live auction sale catalogue www.easyliveauction.com. Prospective Buyers who wish view in person can do this by scheduling an appointment during designated times prior to the sale. Details can be found on the auction information available on the Easy Live website and the website for the salerooms www.westernsalerooms.co.uk

Liability for Damage - Anyone handling lots does so at their own risk and is liable for any loss or damage caused. If a lot is damaged by a member of the public, the auctioneer will determine the cost of the damage, and their decision is final. The auctioneer may:

• Sell the lot without reserve and hold the individual responsible for any shortfall between the hammer price and the reserve or low estimate.
• Charge the individual for restoration costs, if applicable.
• Hold the individual liable for the full reserve price or low estimate, as appropriate.

Lot information

Second-hand Upholstered Furnishings
All relevant goods must comply with safety regulations made under the “Consumer Protection Act 1987” and the “Furnishings Fire/Safety Regulations 1988”. Upholstered items manufactured since 1988 must carry appropriate fire safety labels, indicating compliance with safety standards. Items made before 1950 are exempt from these regulations and are sold as antiques, typically intended for display or research rather than domestic use.

Post-1950 Works of Art & Collectable Furniture
Items in this category are marketed as artistic works. They may not comply with fire safety regulations; therefore, items should not be used in residential settings. It is the purchaser’s responsibility to ensure compliance before resale or domestic use.

Clocks, Watches & Scientific Instruments
Clocks, watches, barometers, and other scientific instruments are sold strictly “as viewed,” without any guarantees regarding their operational condition or suitability for specific purposes. These items are not tested, and the auctioneers provide no warranties of any kind. Buyers are responsible for inspecting and assessing the condition and functionality of such items based on their own judgment.

Books and Other Printed Material & Philatelic Items
These are not sold subject to collation, nor do the Auctioneers offer any guarantees as to genuineness. Intending Buyers should therefore satisfy themselves as to the authenticity, completeness or otherwise of lots, as all are sold as viewed and are not returnable

Motor Vehicles
Motor vehicles and trailers are sold “as seen,” without any testing for functionality, roadworthiness, or compliance with regulations. They may not be immediately roadworthy or may be of such a design as will not without alteration comply with the Acts and Regulations relating to their construction, equipment or use. The purchaser should carefully inspect vehicles and associated documentation, which may vary in availability. No warranties are provided regarding condition, odometer readings, or suitability for use on public roads.
Purchasers must sign an undertaking confirming responsibility for ensuring the vehicle is roadworthy at their own expense before use. An MOT Certificate is not evidence of the road worthiness of any vehicle, and all vehicles or machinery are ‘sold as seen’, as they stand, with all their faults, regardless of the catalogue description.
Prospective Buyers are reminded that when inspecting/attempting to test such lots, they do so at their absolute risk and without any responsibility whatsoever, on the part of the Seller, the Auctioneers or their contractors.
It is an offence to operate a non-compliant vehicle on public roads. Buyers inspect and test vehicles at their own risk, and all sales are final, with no guarantees from the auctioneers or Vendors.

Militaria and Associated Items
Items in this category are sold without guarantees of authenticity; Buyers should independently assess the legitimacy/ authenticity of the items, as some may be copies or replicas. It is advisable to conduct research or seek expert opinions.

Gold, Silver and Precious Metals
In conforming to hallmarking legislation: whether British or foreign, articles which do not carry hallmarks are described either as gold or silver coloured metal, yellow or white metal, as considered most appropriate This distinction is crucial for Buyers to understand the nature and value of the items they are purchasing.

Pictures, Statuary & Works of Art
Works described as signed or attributed to specific artists are considered original; however, additional qualifiers (e.g., “in the manner of”) are provided without warranties. Buyers are advised to perform their own assessments regarding authenticity and value.

Chemicals & Liquids
Buyers of chemical items are reminded of their responsibilities under the Poisons Act 1972 and related regulations. A local authority license may be required for the storage of certain substances. Any hazardous fluids remaining in purchased lots must be removed from the site in accordance with safety regulations.

Helmets & Clothing
Helmets offered for sale do not conform to safety standards for motorcycle use and are not approved under relevant regulations. Additionally, all textile products sold as “old” are defined in accordance with statutory regulations, meaning they do not carry guarantees regarding quality or safety.

Trade and Scrap Lots
Items classified as trade or scrap lots are restricted to businesses that deal in similar goods. Buyers must be aware of their legal obligations and will need to sign a relevant form confirming their understanding of these responsibilities.

Mechanical and Electrical Items
All mechanical and electrical items are sold “as-is,” without any guarantee of functionality, suitability for purpose, or compliance with health and safety regulations. These items may require repairs, restoration, or evaluation by a qualified professional before use. They are typically intended for display, historical interest, or artistic purposes, rather than practical use. Electrical goods are sold as scrap or antiques, even if they bear a Portable Appliance Testing (PAT) label, which does not indicate working condition. Buyers should thoroughly inspect items and refer to relevant safety standards, as all sales are final, and no warranties are provided.

Important Notice
All lots must undergo inspection, repair, and certification to ensure compliance with current regulations, including health and safety laws. Buyers must recognise their duty of care and responsibility before reusing or reselling any purchased items.
Buyers Registration - Buyers will register through the online platform Easy Live Auctions www.easyliveauction.com for timed auctions or in person on arrival with Western Salerooms for live sales.

Bidding at Auctions - Buyers should only place bids if they truly intend to make a purchase. If your bid is accepted, our Terms of Sale will apply, and you will be required to fulfil the obligations outlined in those terms. Bidding is done at the buyer's own risk, and bidders act as principals. By placing a bid, you acknowledge and agree to these terms.
All bids are accepted exclusive of Buyers premium and any delivery or postage charge agreed with the auctioneer prior to bidding.

Bidding Increments - The auctioneer determines the bidding increments at their discretion during the auction.

Hammer Price - The “hammer price” refers to the final bid accepted by the auctioneer, signifying the sale price of a lot.

Finality of Bids - Once placed, all bids are final and binding; they cannot be withdrawn. The auctioneer’s decision regarding the sale is conclusive and cannot be challenged.

At the fall of the hammer, the highest bidder becomes the purchaser. Any disputes regarding bids will be resolved at the auctioneer’s discretion, whose decision is final.

Upon the conclusion of the bidding, the highest bidder is declared the purchaser. Any disagreements related to bids will be settled at the auctioneer's discretion, and their decision is final.

The contract between you and the seller - A contract for the purchase of the lot will be formed between you and the Vendor / Seller when the hammer falls accepting the highest bid for the lot at the auction.

Dispute Resolution - In the event of a dispute over a bid at a live auction, the auctioneer may choose to reopen the bidding for the lot during the auction or settle the issue through other reasonable means. The auctioneer’s decision on such matters is final.

Timed online Bidding Procedures - We provide an online bidding service through Easy Live Auction www.easyliveauction.com

Absentee Bids at a live auction - Absentee bids allow participants to place bids in advance of the auction. These bids are executed on behalf of the bidder up to the specified maximum limit.

The auctioneer will, on the prospective Buyer’s written instruction, execute bids on their behalf at no additional charge. Neither the auctioneer nor his employees and agents will be liable for any negligence or failure in this process. In cases of identical bids, the earliest received will take precedence. A maximum bid limit must always be specified. No unlimited bids will be accepted. Lots will be purchased at the lowest bid possible when considering other bids and any reserves.

1. Sell the damaged lot without reserve and hold the person responsible liable for any difference between the hammer price and the reserve or low estimate.
2. Hold the person responsible liable for the cost of restoration, if applicable.
