Founded in 1907, Outhwaite & Litherland is an independent, family run business. We offer expert advice both regionally and nationwide and aim to help and advise people. We are very much still a family firm with a wide reach and long history of being the first port of call for both individuals and professionals looking for help and advice with regards to antiques and valuable items.

Outhwaite & Litherland have been putting our clients first since 1907, in our 116 years we have seen two world wars, countless Prime Ministers and a world change beyond recognition in many ways. However, Outhwaite & Litherland are a constant, we are and have always been expert auctioneers and valuers, approachable and happy to discuss items, offer advice and trusted to help people at difficult times such as family bereavement and matrimonial division.

1. The highest accepted bidder shall be the purchaser. If any dispute should arise between bidders or any mistake is made the lot may be put up again. The auctioneer is the final arbiter

2. The advance in the bidding will be regulated by the auctioneer who reserves the right to refuse any bidding, or to bid on behalf of the vendor on any lots upon which there is a reserve, or to withdraw, consolidate or divide any lot before or during the sale

3. No lots may be removed until the purchaser’s account is paid in full. The buyer shall not become the owner or any lot and the auctioneer shall have a lien thereon until the purchaser’s account is paid, but after the fall of the hammer the risk of damage or loss shall nevertheless be the buyer’s

4. All lots must be paid for and removed within one week of the sale (by appointment). Purchasers who do not pay and collect by this time will be charged £5 per day storage and may have their bids refused in future sales

5. Payment can be made by cash or bank transfer. Credit Cards are not accepted. Any single transaction above £8,000 will require a copy of proof of ID

6. A buyer’s premium of 20% +VAT is charged on the hammer price

7. Online Bidding
We offer an online bidding service on our website, via easyliveauction.com for bidders who cannot attend the sale. In completing the bidder registration and providing your credit card details and unless alternative arrangements are made with Outhwaite & Litherland:

a. Please note that any lots purchased online via our website or easyliveauction.com will be subject to an additional 3% commission charge plus VAT at the rate imposed on the hammer price on our website or easyliveauction.com

8. Shipping of silver and jewellery and small items weighing under 2kg when packed may be done in house at the discretion of Outhwaite & Litherland, please contact the office to discuss.

9. Items are sent entirely at the buyer's risk and in the event of loss or damage to items posted it is the buyer’s responsibility to make any claim from the insurance (if any) made on their behalf

10. Any damage caused by removal of goods must be made good by the person committing the same. Principles being considered responsible for the acts of their servants.

11. The auctioneer undertakes that care has been taken to see that catalogue descriptions and condition reports are accurate, but these must be taken as matters of opinion only and shall not be taken as statements of fact. Buyers must make their own judgement as to the nature, authenticity, or condition of any lot. The auctioneers do not give any warranty as to the title of the lots sold and will not be liable for any defect in such title.

12. Any items remaining unpaid for may be resold and any deficiency made good by the defaulter

Conditions of acceptance of goods for auction:

1. Goods will be entered in the appropriate auction as decided by the auctioneers. The proceeds of sale can be collected from eight days after each sale, otherwise all funds will be sent via BACS within four weeks of the sale. There may be a delay in payment if items are not paid for by the buyer

2. Commission: 20% + VAT on all items. Minimum charge £5 per lot.

3. Goods collected by our carrier will be subject to a carrier charge that will be deducted from the proceeds of sale and agreed with the vendor prior to collection.

4. The Seller warrants to the auctioneers and to the buyer that he is the true owner of the goods or is properly authorised to sell the goods by the true owner and is able to transfer good title to the goods free from any third party claims. The Seller indemnifies the auctioneer and the buyer against any loss or damage suffered by either, in consequence of any breach of this condition by the seller.

5. All goods are put up for sale without reserve unless written instructions are agreed. Reserves will be adhered to within 10% auctioneer’s discretion. Unless otherwise agreed any goods failing to reach their reserve may be re-offered in a subsequent auction at the auctioneer’s discretion.

6. Items withdrawn by a vendor prior to a sale may be subject to a fee of 25% of the expected selling price or reserve

7. An electrical testing fee of £4 per item plus VAT may be charged

8. The seller warrants all electrical and mechanical goods, unless otherwise agreed with the auctioneers, to be in working order or reasonably fit for their intended use. In the case of goods discovered after the sale not to conform to the above warranty, the auctioneers reserves the right to withhold payment to the seller and to resell or dispose of the goods subsequently without notification of the same to the seller

9. The auctioneers reserve the right to re-offer for sale on behalf of the seller any goods for which payment is not received through default of the buyer

10. The auctioneers reserves the right to re-offer, re-cycle or dispose of any items that fail to sell. Any items of an unsaleable nature may be disposed of before an auction. A charge for disposal may be made.

11. The seller hereby agrees to forfeit any interest that may be earned on proceeds of sale.

12. Items consigned are insured under our office/saleroom policy and we are responsible to you for damage or loss according to the terms of this insurance (available on request). We agree that the amount insured is the expected or realised auction sale price or agreed reserve net of charges, not exceeding the current market value.
We can arrange in house P&P for smaller items, silver, jewellery, and small items weighing under 2kg once packed, please contact us prior to bidding to discuss P&P options, we will not arrange packing only.
